Also known as “Liquidation” bankruptcy, Ch. 7 is by far the most common type of bankruptcy filed by debtors. It can eliminate most unsecured debts such as credit cards, payday loans, and medical bills. If you qualify, you’ll want to use Ch. 7!

Chapter 13 is the best remedy for individuals who wish to reorganize and pay on some key debts, such as mortgages or car loans, over a period of 3-5 years. Ch. 13 is for debtors who have enough left each month to pay back at least a portion of their debts. The amount repaid depends on amount of earnings, debts, and how much property is owned. Typically, Chapter 13 bankruptcy is for debtors who:
don't qualify for Chapter 7 but need debt relief to lower credit card payments, stop litigation, prevent a wage garnishment
have nondischargeable debts such as arrearages in spousal or child support that they'd like to catch up on, or
have fallen behind on house or car payments and want to catch up on and keep the property.
